Using the coast guard rules for sailing vessels, the one that applies in my
mind is When both boats are

windward <http://www.scils.rutgers.edu/~elfox/terms.html#windward> must keep
clear. "

In this case the larger vessel must keep clear.  Of course, since this is a
photoshopped picture, you cannot trust the tack presented by the position of
the sails.
